Terms & Conditions

Governed by the Laws of New Zealand • Effective Date: January 2025

1. Definitions & Interpretation

In these Terms & Conditions ("Terms"), the expressions "Zealandia", "we", "us", or "our" refer to Zealandia Expedition Journal (NZBN 9429051829101). The terms "User", "you", or "Client" refer to any natural or legal person browsing our publications or engaging our custom expedition advisory services.

2. Acceptance & Lawful Use

By browsing zealandia-journal.co.nz or submitting an advisory intake form, you agree to be bound by these Terms in full. You agree to utilize our content strictly for lawful personal research and undertake not to reproduce, scrape, duplicate, or commercially resell our field notes without prior written authorization.

3. Nature of Content & Editorial Scope

Zealandia publishes informational articles, topographic overviews, and travel itineraries based on field research. While every effort is made to maintain track currency, New Zealand alpine environments are inherently dynamic: slips, avalanches, river washouts, and severe weather can alter track conditions overnight. Our articles do not substitute for official Department of Conservation (DOC) warnings or Mountain Safety Council forecasts.

4. Consultation Orders & Engagements

Any request for custom itinerary design, campervan circuit schedules, or one-on-one video advisory creates a contractual relationship only upon written confirmation and payment receipt. We reserve the right to decline route advisory requests where proposed itineraries violate conservation bylaws or pose extreme reckless alpine hazard.

5. Pricing & Currency

All itinerary fees and consultation rates displayed on this platform are expressed in New Zealand Dollars (NZD). Applicable Goods and Services Tax (GST) is clearly indicated where appropriate.

6. Cancellations & Rescheduling

Consultation appointments rescheduled with at least 48 hours prior notice may be shifted without penalty. Given the bespoke research nature of delivered PDF itinerary packages, delivered route files are non-refundable once sent to the client.

7. Client Physical & Legal Responsibilities

Clients are solely responsible for ensuring personal physical fitness, obtaining comprehensive travel and medical rescue insurance, possessing appropriate driver's licenses, and complying with New Zealand biosecurity laws, driving codes, and freedom camping bylaws.

8. Intellectual Property

All text, photography, graphic representations, maps, code, and logo marks displayed on this site are the exclusive intellectual property of Zealandia or licensed under legitimate copyright agreements. Unsanctioned republication or commercial exploitation is strictly prohibited under the New Zealand Copyright Act 1994.

9. Confidentiality

Both parties agree to treat personal communications, proprietary route co-ordinates, and transaction records with absolute confidentiality, subject to disclosures mandated by applicable law.

10. Disclaimer of Warranties ("As Is")

Except as expressly provided under the Consumer Guarantees Act 1993 (where applicable to New Zealand consumers), our content, itineraries, and advisory dispatches are provided on an "as is" and "as available" basis without express or implied warranties of any kind.

11. Limitation of Liability

To the maximum extent permitted by the laws of New Zealand, Zealandia, its directors, researchers, and contributors shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from trail accidents, vehicle breakdowns, weather delays, flight cancellations, or personal injury sustained during travel.

12. Indemnification

You agree to indemnify and hold harmless Zealandia and its staff against any claims, losses, liabilities, costs, or expenses (including legal fees) resulting from your violation of these Terms or non-compliance with New Zealand laws.

13. Third-Party Links & Neutrality

Hyperlinks pointing to third-party commercial transport providers or accommodation properties do not constitute an endorsement. We maintain editorial neutrality and do not accept liability for third-party service failures.

14. Force Majeure

We are not liable for failure or delay in fulfilling advisory obligations caused by events beyond our reasonable control, including earthquakes, volcanic eruptions, road washouts, pandemics, strikes, or sovereign government restrictions.

15. Applicable Law & Jurisdiction

These Terms are governed exclusively by and construed in accordance with the laws of New Zealand. Any dispute arising out of these Terms shall be subject to the exclusive jurisdiction of the Courts of New Zealand.

16. Modifications to Terms

We reserve the right to revise these Terms at any time without individual prior notice. Continued use of our website constitutes affirmative acceptance of revised terms.
